The maximum value of the Incentive (the “Maximum Value of the Incentive”) varies between Qualifying Homes as described herein. The Maximum Value of the Incentive as advertised above (i.e., up to $40,000) is based on the Maximum Value of the Incentive applicable to Qualifying Homes in the WestRidge at Westphalia (Upper Marlboro, MD) subdivision, as shown below. Limit one (1) Incentive per Qualifying Contract irrespective of the number of homebuyers thereunder. The Incentive may only be used by the homebuyer toward the purchase of the applicable Qualifying Home under the Qualifying Contract as follows: (1) a reduction of (i.e., credit toward) the actual closing costs incurred by the homeowner with respect to the purchase of the applicable Qualifying Home under the Qualifying Contract (“Option 1”); (2) a reduction of (i.e., credit toward) the cost of design option selections made by the homeowner with respect to the applicable Qualifying Home under the Qualifying Contract (“Option 2”), (3) a credit toward/for payment of points to reduce the interest rate of the life of the homebuyer’s loan to purchase the applicable Qualifying Home under the Qualifying Contract with the lender selected by the homebuyer (“Option 3”), (4) a credit toward/for payment temporarily reducing the homebuyer’s mortgage payment amount during the initial year(s) of the homebuyer’s loan to purchase the applicable Qualifying Home under the Qualifying Contract with the lender selected by the homebuyer (“Option 4”), (5) a reduction of (i.e., credit toward) the total price of the Qualifying Home under the Qualifying Contract (“Option 5”), or (6) any combination of the foregoing Options 1-5 (inclusive), up to, in aggregate, the total Maximum Value of the Incentive, as applicable. YOU SHOULD CHECK WITH YOUR LENDER TO DETERMINE SPECIFICALLY HOW THE INCENTIVE MAY BE APPLIED BASED ON THE LOAN PRODUCT THAT YOU CHOOSE. DRB Homes makes no representation or warranty as to any incentives, programs, loan products, or other offerings of any lenders (including, without limitation, those described in Options 3 and 4 above) or whether the same may be available to any homebuyer. All closing credit(s) described in Options 1 through 5 (inclusive) above represent credit(s) from DRB Homes and are subject to additional terms and restrictions placed by DRB Homes’ approved lender(s) and/or applicable law. DRB Homes makes no guarantee that any such credits from DRB Homes may be received by any homebuyer. For the avoidance of doubt, the homebuyer shall be responsible for all of closing cost amounts and design option costs that are not offset by/exceed the credit(s) issued from DRB Homes in connection with the Incentive. The homebuyer is responsible for all design option selections. An additional or increased deposit may be required in connection with certain design option selections. The homebuyer must select all design options for which the Incentive is to be applied in connection with Option 2 no later than the time that all design option selections must be completed pursuant to the terms of the Qualifying Contract, and such selections shall be memorialized pursuant to one or more addenda or change orders to the Qualifying Contract. All design options are limited to the specific items designated/made available for selection by DRB Homes, subject to configuration, design, and other limitations related to the floor plan of the home. Not all design options are available for all homes. If the homebuyer does not use (or cannot use) the Incentive up to the applicable Maximum Value of the Incentive, the homebuyer shall not be entitled to receive cash and/or any alternative or substitute so that the applicable Maximum Value of the Incentive may be realized by the homebuyer. As used herein, “Qualifying Home” shall mean and refer, individually, to each of DRB Homes’ to-be-built and previously constructed inventory homes in the following subdivisions: (i) WestRidge at Westphalia (Upper Marlboro, MD) [the Maximum Value of the Incentive is up to $40,000 with respect to Qualifying Homes located in the subdivisions identified in this subpart (i)]; (ii) Greenleigh Townhomes (Middle River, MD) [the Maximum Value of the Incentive is up to $35,000 with respect to Qualifying Homes located in the subdivision identified in this subpart (ii)]; (iii) Locke Landing (Baltimore, MD), Montgomery Village Center (Montgomery Village, MD), Greenleigh Single Family Homes (Middle River, MD), and South Lake (Bowie, MD) [the Maximum Value of the Incentive is up to $25,000 with respect to Qualifying Homes located in the subdivisions identified in this subpart (iii), provided, however, the Maximum Value of the Incentive for Homesite N55 in the South Lake (Bowie, MD) subdivision is up to $40,000]; (iv) The Village at Cabin Branch (Clarksburg, MD) [the Maximum Value of the Incentive is up to $20,000 with respect to Qualifying Homes located in the subdivisions identified in this subpart (iv)]; (v) Tuscarora Creek East Single Family Homes (Federick, MD) [the Maximum Value of the Incentive is up to $17,500 with respect to Qualifying Homes located in the subdivision identified in this subpart (v)]; (v) Hammaker Hills (Thurmont, MD) [the Maximum Value of the Incentive is up to $15,000 with respect to Qualifying Homes located in the subdivision identified in this subpart (vi), provided, however, the Maximum Value of the Incentive for Homesite 39 in the Hammaker Hills (Thurmont, MD) subdivision is up to $20,000]; (vii) Tuscarora Creek East Townhomes (Frederick, MD) [the Maximum Value of the Incentive is up to $12,500 with respect to Qualifying Homes located in the subdivision identified in this subpart (vii)]; and (viii) Brunswick Crossing (Brunswick, MD) [the Maximum Value of the Incentive is up to $10,000 with respect to Qualifying Homes located in the subdivision identified in this subpart (viii)]. The Village at Cabin Branch subdivision (Clarksburg, MD) identified above is intended to provide housing primarily for persons fifty-five (55) years of age or older and is operated as an age-restricted community in compliance with all applicable state and federal laws. At all times, at least eighty percent (80%) of the homes within the Village at Cabin Branch (Clarksburg, MD) subdivision must be occupied by at least one (1) individual fifty-five (55) years of age or older. This advertisement shall not constitute an offer or solicitation in any state where prior registration is required. The homebuyer shall be responsible for all of amounts which are not offset by/exceed the credit(s) issued from DRB Homes in connection with the Incentive. Additional limitations apply. The Incentive is non-transferable, non-exchangeable, non-assignable, and cannot be redeemed for cash. DRB Homes may, in its sole discretion, and without prior notice, modify or discontinue the Incentive at any time. The following disclosure is made in accordance with §10-710 of the Real Property Article of the Maryland Code: (1) In Prince George’s County, a contract of sale for residential real property that includes an agreement by the home builder to provide a community amenity shall include a disclosure statement that: (I) Identifies the community amenity provided in the contract of sale, and (II) Specifies when the community amenity will be completed in accordance with a recreational facilities agreement recorded with the Prince George’s County Planning Department; (2) The disclosure statement required under the foregoing subpart (1) shall be: (A) Dated and signed by the purchaser and the home builder; and (B) Included in or attached to the contract of sale; and (3) A purchaser who does not receive the disclosure statement required under the foregoing subpart (1) on or before entering into the contract of sale has an unconditional right, on written notice to the home builder, to rescind the contract of sale at any time: (X) Before the receipt of the disclosure statement; or (Y) Within 5 days after receipt of the disclosure statement).
